1. The objective of the SEAbrary website is to facilitate wide dissemination and exchange of maritime safety information to and between maritime professionals in order to raise their awareness of maritime safety related issues.

The information uploaded on the SEAbrary website (in whatever format, i.e. all documents, data, articles, representations, statements) originates from various sources and authors contributing articles to SEAbrary . The information is periodically reviewed and edited by SEAbrary in an endeavour to present the information in a uniform ‘SEAbrary ’ format.

2. However, the use of this website is at the user’s sole responsibility and risk. SEAbrary expressly disclaim any warranty with respect to the information on the website, including its accuracy, completeness, reliability, quality, fitness for a particular purpose, representation of state-of-the-art technology or regulation.

Privacy statement on the protection of personal data

The SEAbrary website offers an insight into maritime safety knowledge to a wide range of people interested in navigational safety and sea traffic management. It also links visitors to external sites, which are considered of interest to the maritime community.

2. Why do we collect, store and process data about you?

SEAbrary may collect and process your personal data namely for the following reasons:

  • subscription to SEAbrary and the SEAbrary newsletters;
  • contribution of content items (e.g. articles, presentations, video recordings) to SEAbrary , which contain personal information;
  • provision of feedback, comments and content improvement suggestions;
  • enabling registered users to access specific SEAbrary features; 
  • registration to safety events and conferences;
  • web site statistics.

The collection of your personal data when you subscribe as a registered user relies on your consent to provide it by filling the relevant form and accepting that you have read this privacy notice or by giving your explicit consent to publish a content item (e.g. a presentation or video recording) that contains personal data.

Content from other sources rely on the legal basis of the original data controller.

Contributions from SEAbrary staff are considered to be done in the performance of the tasks and functions of the Organisation.

3. What data do we collect, store and process via the SEAbrary website?

Some of the services offered on our website require the processing of your personal data.

The personal data we collect is divided into the following subsets:

a) Subscription data

When you become a registered user by subscribing to the SEAbrary newsletter, or by registering to SEAbrary , SEAbrary gathers in a dedicated database the personal data necessary to process your request. Furthermore, when launching newsletter campaigns we gather data to assess the impact of a campaign. Hence, depending on the nature of the subscription, the following data might be gathered and stored in SEAbrary's dedicated database:

  • name;
  • job title;
  • email;
  • company name;
  • country of residence;
  • log-in data
  • IP address.

b) Contributor's data

Content contribution to SEAbrary (e.g. an article, a presentation or video recording), whether submitted by you directly or via a third party (e.g. event organising committee), will be made freely accessible to the public in accordance with the Licence agreement and Code of conduct. . Depending on the content type it may contain the following personal data:

  • personal photo or image;
  • name;
  • profession and/or post;
  • affiliation;
  • short bio data; 
  • views on or attitudes to particular topics or subjects.

When you submit to SEAbrary an inquiry, feedback, comments or other information relevant to the SEAbrary content or your subscription, SEAbrary gathers in a dedicated database the personal data necessary to process your input. Depending on the input subject, the following data might be gathered and stored in SEAbrary ’sdedicated database:

  • name;
  • email address;
  • log-in data;
  • submitted feedback, comments and/or view on a particular topic or subject. 

c) Tracking data

Tracking data generated by SEAbrary's email campaigns is kept and used in anonymised form solely for statistical purposes, i.e. to establish the usefulness of the SEAbrary email campaigns. Personal tracking data will not be used.

d) Cookies data

Cookies are short text files stored on a user’s device (such as a computer, tablet or phone) by a website, which could be used for the technical functioning of a website, for gathering statistics on the use of the website or for other purposes, such as to provide a user with a more personalised experience. On the SEAbrary website we use only web analytics cookies.

e) Control of cookies on this website

A banner is displayed on every page of the website, informing you of the use of cookies and giving you the possibility to opt-in or opt-out. If you choose to opt-in (and thus being tracked), you can always change your mind and opt-out.

f) Social media cookies

Cookies are not set by our display of social media buttons, in our website pages or from the use of embedded components from those services (e.g. Vimeo).

Each social media channel has their own policy on the way they process your personal data when you access their sites.

4. Who is your data disclosed to? Who has access to your data? 

Access to your personal data collected as part of the subscription and user feedback processes is provided to SEAbrary core team that includes SEAbrary staff and external contractors, who are responsible for the user registration process, content management, website use analysis and SEAbrary's email campaigns, as applicable. Such staff abide by statutory confidentiality requirements, and contractors by confidentiality agreements.

Access to your personal data collected as part of the content contribution and publication process (e.g. personal data contained in an article, a presentation or video recording) is provided to the public (SEAbrary user community) in accordance with the Licence agreement and Code of conduct. .

5. How long is your data kept?

Your personal data will be kept in the SEAbrary users database until you unsubscribe as registered user or you request to the  website administrator  to delete your personal data or content contribution that contains your personal data.

6. What are your rights under the SEAbrary Data Protection Regulation

You have the right to access, rectify, complete and update your data:

a) using self-service interfaces (i.e. online tool function to edit your profile) and the update is immediate/option.

b) by contacting the  website administrator . You have the right to object to the use of your personal data in some circumstances. You may also delete your personal information. You have the right to request additional information about the handling of your personal data by contacting the  website administrator .

7. How can you withdraw consent you have given to SEAbrary ?

You may withdraw your consent at any moment by contacting the  website administrator  or by unsubscribing directly via the SEAbrary highlight message. Once SEAbrary has received notification that you have withdrawn your consent, SEAbrary will no longer process your information for the purpose(s) you originally agreed to.

8. What do we do to avoid misuse or unauthorised access to personal data concerning you?

SEAbrary is committed to ensuring that your information is secure. In order to prevent unauthorised access or disclosure, SEAbrary has put in place suitable physical, electronic and managerial procedures to safeguard and secure the information collected online. Staff handling your data are bound by confidentiality obligations.

9. What safeguards do we apply when we transfer your data to third parties?

Your personal data is only given to a very limited set of contractors for the performance of their tasks (see section 4 above). Contracts with our contractors contain appropriate confidentiality obligations. 

10. Who can you contact if you have questions or want to make a complaint?

For any queries related to your personal data, please contact the  website administrator  who is the role responsible for the processing of the personal data concerning you.

Complaints can be addressed to SEAbrary ’s  Data Protection Officer .

Licence agreement and Code of conduct

SEAbrary LICENCE AGREEMENT

Preamble

The objective of the SEAbrary website is to facilitate wide dissemination and exchange of maritime safety information to and between maritime professionals in order to raise their awareness of maritime safety related issues. SEAbrary is owned and managed by SEAbrary . The SEAbrary concept is based primarily on a database of maritime safety information presented in articles and other knowledge items (e.g. reports, video clips, presentations) organised according to aviation safety related topics. Article uniformity and style are defined by SEAbrary . The knowledge database is fed by authors, such as SEAbrary , partners, collaborators and those registered users of SEAbrary who have been invited or volunteered to contribute articles or other content.

Definitions

Article  - An article is aviation safety related information which is presented in the form of text in SEAbrary . The article may be composed of various elements, such as text, graphic elements, tables or other.

Article Attachment  – An article attachment is a document in whatever electronic format (software) which may be attached to an article in the sense that it will only be displayed if specifically accessed by the user. Unless specifically mentioned, the term ‘article’ used in this Licence Agreement includes the Article Attachments.

Author  – An author is a person who creates a knowledge item and then contributes it to SEAbrary . 

Knowledge item  - means variously an article, a document, a presentation, a video or audio recording, an image, a graph.

Marked parts  – are those parts of a knowledge item that visibly display the following copyright notice: © [year] [name]. Such parts may, for example, be text, images, tables or graphs. Those parts are not modifiable parts and not subject of the rights of the user under this Licence Agreement.

Modified version  – The modified version is any further version of the knowledge item or its parts which are not marked parts, other than the original version. It may be created by the author of the original version or any other author under this Licence Agreement.

Original version  – The original version is the first version of a knowledge item at the time the item was created by the author.

SEAbrary - SEAbrary is a 3 year Research and Innovation action funded by the H2020 programme. The project brings together a strong consortium consisting of industry, academia,within the aviation and maritime sector, with the aim of consolidating best practices for Human Factors input to transport safety.

SEAbrary  - SEAbrary is a an electronic platform, dedicated to the collection and dissemination of maritime safety related knowledge primarily through a database of articles and other functionalities, such as a toolkits and online tutorials. SEAbrary is responsible for all technical aspects, content management and layout of SEAbrary .

User  – Any person or legal entity accessing SEAbrary on the internet and thereby having the possibility to view or make other use of the knowledge items contained in SEAbrary . Users may register in order to become authors or provide feedback.

Purpose and Scope

  1. The purpose of this Licence Agreement is to define the rights and obligations of the authors and users of SEAbrary concerning the intellectual property rights (exploitation rights, usage rights) related to articles, parts of the articles, article attachments contributed to SEAbrary by the authors.
  2. Any knowledge items which are accessible through internet links contained in SEAbrary (other than articles and article attachments, see definition above) are outside the scope of this licence agreement.

Conclusion of the Licence Agreement

  1. By submitting a knowledge item to the SEAbrary team or by the technical means foreseen on the SEAbrary website the author offers to any potential user of SEAbrary to make use of the knowledge item subject to this Licence Agreement.
  2. This Licence Agreement is concluded between the author and a user of SEAbrary at the moment the user accesses a knowledge item contained in SEAbrary , irrespective of receipt of the declaration of its acceptance by the author.

Scope of the Licence

  1. The rights granted to the user under this Article 5 shall be non-exclusive, unlimited in time and free of charge.
  2. The user shall have the rights to copy, print, download, publish, distribute or otherwise provide or make accessible an article, to the public for his own purposes and free of charge. Any copy of the article or its parts shall display the following reference to SEAbrary and – if displayed in the original version – to its author: “Source:  www.SEAbrary .com , As regards marked parts of the article, the user shall only have the right to download and print them for his own purposes.
  3. The user may not grant sub-licences to third parties other than set out in section Purpose and Scope above.
  4. The User shall have the right to modify the modifiable parts of the article (i.e. those which are not marked parts) on the conditions that the modified version displays the following reference to SEAbrary , the original version and – if displayed in the original version – to its author: “based on the article [title of article], [author name], source:  www.SEAbrary .com ”.
  5. With regard to the modified version, the user shall have the rights set out under Purpose and Scope (2) above.
  6. The rights of the user set out in section Purpose and Scope shall not limit or modify the rights of the author with regard to the same article under this Licence Agreement.
  7. The provisions in section Purpose and Scope shall not apply to Article Attachments. Any intellectual property rights attached to Article Attachments prior to their submission to SEAbrary together with an article shall remain unaffected.

Liability

  1. The author warrants that they hold all necessary intellectual property rights to the knowledge item, its parts, the original or modified version, allowing them to submit that knowledge item to SEAbrary subject to this Licence Agreement.
  2. The author warrants that by submitting a knowledge item to SEAbrary he does not infringe any Third Parties’ intellectual property rights.
  3. The author shall hold harmless the user from any claims for damages made by Third Parties for the infringement of their intellectual property rights caused by the author in breach of his obligation under Conclusion of the Licence Agreement (1) above.
  4. Notwithstanding Conclusion of the Licence Agreement (1) and (2) above, the liability of the user and author under this Licence Agreement shall be limited to gross negligence and wilful misconduct.

Termination

  1. In case of breach of the terms of this Licence Agreement by the user, the rights of that user set out in section Purpose and Scope above shall expire with immediate effect.
  2. The author may terminate this Licence Agreement any time by giving notice to SEAbrary by the SEAbrary e-mailing function. Upon receipt of the notice, SEAbrary shall withdraw the knowledge item from SEAbrary without undue delay.
  3. In case of termination as set out in paragraph 2 above, any exploitation of the knowledge item carried out until the time of withdrawal of the knowledge item from SEAbrary shall be within the scope of this Licence Agreement.
  4. Neither the author nor the user shall be entitled to claim damages arising out of or after the termination of this Licence Agreement.

Amendment of the Licence Agreement

  1. SEAbrary may from time to time amend this Licence Agreement.
  2. The new version shall be made available on SEAbrary and shall become effective from that date and be applicable to knowledge items subsequently submitted to SEAbrary .

Applicable Law and Jurisdiction

This Agreement shall be subject to English Law. The competent courts shall be the courts of UK.

CODE OF CONDUCT FOR USERS OF THE SEAbrary FEEDBACK FUNCTION

  1. Only registered users of the SEAbrary website may submit feedback contributions to the SEAbrary knowledge items.
  2. The contribution should be linked to a particular knowledge item.
  3. The Feedback function is dedicated to discussions between SEAbrary users and content management team. Therefore, the user should not attach files to his contribution which consume a large amount of data (e.g. pictures). Links to other websites are usually sufficient. Attached files may be removed without notice if they are considered to be too large.
  4. The following is strictly prohibited:
    1. use of the SEAbrary Feedback function for commercial purposes;
    2. defamatory, offensive or otherwise unacceptable content;
    3. content, the dissemination of which is a criminal offence.
  5. Any intellectual property rights in the contribution as a whole remain with the user, who, by submitting his contribution grants an unlimited, free-of-charge, exclusive licence to SEAbrary to use the contribution as a whole or parts of it for the purposes of SEAbrary , including for editing of existing SEAbrary knowledge items or the creation of new ones.
  6. SEAbrary reserves the right to remove any contribution in whole or in part from the SEAbrary Feedback database and to block the user’s IP address and username without prior notice at its discretion, in particular in cases of prohibited conduct of the user as set out in paragraph 4 above.
